Terms of Service
This is a pre-launch site for an app that isn't out yet. Reserving a founding price isn't a purchase and costs nothing today — it just adds you to the launch list at the founding price we intend to honor. The site is provided as-is while we build, and these terms include the usual legal protections (warranty disclaimer, liability cap, and dispute resolution).
1. Acceptance of these terms
By using this website or reserving early access, you confirm that you are at least 18 years of age (or have a parent or guardian's permission), that you have read these Terms and our Privacy Policy, and that you agree to them. If you don't agree, please don't use the site. These Terms are an agreement between you and Apex Development Studio LLC ("we," "us").
2. What this service is
This website is an informational, pre-launch page for an iOS app currently in development, named Daily Crescendo. The app is not yet available, and nothing here is an offer to sell a finished product.
3. Reservations and the "founding price"
- Reserving early access means giving us your email so we can notify you at launch. It is not a purchase, no payment is taken, and no account is created.
- The "founding price" (for example, a discounted lifetime price) is our good-faith intention for early reservers at launch. It is not a binding contract or guaranteed offer, and it may change.
- We make no guarantee of launch date, final price, feature set, or that the app will be released at all. Reserving creates no entitlement or obligation to purchase. Software plans change.
4. License
If and when the app is released, we grant you a personal, limited, non-exclusive, non-transferable, revocable license to use it on Apple-branded devices you own or control, for your personal, non-commercial use, in accordance with these Terms and Apple's Standard EULA (Section 5). This website itself is provided for your personal, informational use.
5. Apple and the Standard EULA
When the app is released through the App Store, your use of it is also governed by Apple's Licensed Application End User License Agreement (the "Standard EULA," available at apple.com/legal/internet-services/itunes/dev/stdeula). You acknowledge that: (a) these Terms are between you and us, not Apple; (b) Apple has no obligation to provide maintenance or support for the app; and (c) Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
6. Your submission
You agree that the email you provide is yours and that your answers are given voluntarily. How we handle this information is described in our Privacy Policy.
7. Intellectual property
The content, design, and branding on this site are owned by Apex Development Studio LLC and may not be copied or reused without permission. "Daily Crescendo" is an unregistered trademark of Apex Development Studio LLC; trademark clearance is in progress.
8. Acceptable use
Please don't attempt to disrupt the site, submit unlawful or abusive content, scrape it at scale, or use it to harm others.
9. Disclaimers
The site is provided "as is" and "as available," without warranties of any kind, express or implied, including the implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law. We do not warrant that the site or the future app will be uninterrupted or error-free, or that any described feature will ship as shown.
10. Limitation of liability
To the fullest extent permitted by law, Apex Development Studio LLC will not be liable for any indirect, incidental, special, or consequential damages arising from your use of this pre-launch website. Our total liability for any claim arising from or relating to the site or the app shall not exceed the amount you paid us in the twelve (12) months preceding the claim (which, for this free pre-launch site, is zero).
11. Indemnification
You agree to indemnify and hold harmless Apex Development Studio LLC from any claims, damages, or expenses (including reasonable attorneys' fees) arising from your use of this site in violation of these Terms or applicable law.
12. Purchases through Apple (at launch)
When the app is released, all purchases will be processed by Apple through the App Store. Apple manages your payment information, and any refund requests are handled by Apple at reportaproblem.apple.com in accordance with Apple's policies; we cannot process refunds directly. Any subscription auto-renews unless cancelled at least 24 hours before the end of the period, and can be managed in your Apple ID settings.
13. Changes to these terms
We may update these Terms as the product develops; the "last updated" date above will reflect any change. Continued use of the site after a change means you accept the updated Terms.
14. Governing law and dispute resolution
These Terms are governed by the laws of the Commonwealth of Virginia, without regard to its conflict-of-law principles. Any dispute or claim arising from or relating to these Terms or the site shall be resolved through binding arbitration administered under the American Arbitration Association's Consumer Arbitration Rules, on an individual basis, rather than in court. Any proceeding shall be conducted on an individual basis only and not as a class, consolidated, or representative action; you waive any right to participate in a class action. Notwithstanding the above, either party may seek injunctive or equitable relief in a court of competent jurisdiction to protect intellectual-property rights.
